Website Design Contract & Terms
Welcome
Nobody loves the fine print, but this agreement ensures clarity, fairness, and alignment for both of us. Please take a moment to read through these Website Design Terms & Conditions.
The Agreement (“Agreement”) is being made between You (“The client”, “You” or “Your Business or Group”) and Melissa Caven Design (that’s “Melissa Caven Design”, “Me” or “I”) You and I may also be referred to as “Our” or “Party” or together as the “Parties”.
Melissa Caven Design is the trading name of Melissa Kate Caven ABN 75 611 920 721
registered in South Australia, 5355.
Pricing & Quotes

A detailed quote/invoice will be provided in AUD before any work begins.

Your quote/invoice includes website design and setup costs and may also include any recommended third-party tools or apps (e.g. Wix hosting, domain, apps).

These third-party costs are your responsibility to pay and manage. I will provide guidence on setting up any apps if applicable.

If you request additional features after the initial quote, the price may be revised and must be approved before continuing.
Payments
-
A 50% deposit is required upfront to secure your booking and begin work.

The remaining 50% is due before the new website design goes live, is transferred, or published.

Payments can be made securely via bank transfer, credit card, or available payment providers.
Project Scope

You will receive a full outline of what’s included in your chosen package (e.g. The Soulful Site or The Full Flow Website).

Add-on requests outside the original scope may incur extra charges.

You’ll receive 2 rounds of revisions as part of your package. Further changes will be charged at an hourly or per project rate. Hourly rate is currently $110p/hr.
Website Content Responsibilities
To begin, I’ll need:

All your website text/copy

Your brands high-resolution images in jpeg or png format

Your logo and branding elements (fonts, colours, logos and graphics)

Links to social accounts and any essential contact info for your site

Any other agreed-upon materials (product lists, service info, booking tools, etc.)

You’ll receive a secure online shared folder to upload your content.
Timelines
-
Estimated project completion is 2–6 weeks from the project start date.

Timely feedback, content delivery, and communication are essential to stay on track. Delays caused by missed communication or providing content late may shift your timeline.

Final payment is still due before website handover, even if delayed due to content.

While I aim to meet all project timelines, there may be delays due to illness, family emergencies, or other unforeseen personal or external circumstances (such as power outages, platform issues, or internet disruptions). In such cases, I’ll communicate promptly and do my best to minimise impact, but I cannot be held responsible for delays outside of my control.
Revision Policy

2 rounds of revisions are included. We encourage you to be as detailed as possible. Specific feedback helps us move forward efficiently and stay within the allocated revision rounds.

You will be provdided with a website preview link. Revisions must be submitted via email, comments on the live feedback link or discussed during a live online meeting review.

Once approved and published, additional design changes will be charged separately.

Final proofreading is your responsibility. I will not be liable for errors once content is approved and live.
Hosting & Domains

I build exclusively on Wix. You are responsible for your own Wix account, domain, and hosting subscriptions.

I will guide you through any transfers and assist with hosting upgrades.

I am not liable for third-party billing issues related to Wix, domains, or email accounts. If any issues arrise please contact the provider directly. In some cases I can assist with Wix billing issues.
SEO Disclaimer

A strong SEO foundation is included (titles, url slugs, meta descriptions, meta tags, alt text, heading tags, Google Search Console connection).

I do not guarantee first-page rankings. SEO is a long-term strategy and may require further investment or management and is unique to every client and industry.
Refunds
-
Deposits are non-refundable due to collaborative nature of the process time invested in planning, strategy, design and onboarding.

If the client cancels the project, a partial refund (minus work completed) may be granted at the designer’s discretion.

If time worked exceeds the deposit, the remaining balance will be invoiced.

We work closely with each client throughout the design process to ensure your website reflects your vision, goals, and brand. Feedback is welcomed and encouraged at every stage, and 2x revision points are built into the project timeline to ensure we stay aligned. I encourage open communication so we can resolve any issues together whether through additional revisions or refinement of the strategy.
Project Holds

If life throws you a curve ball, you may request to put your project on hold for a maximum of 6 months and a $350 holding fee will apply.

A project recommencement date will be provided when you are ready to take your project off hold, please note that it could be weeks or even months before we can reschedule your project.

After 6 months without communication, the project will be cancelled, and all paid funds forfeited.
Communication
-
Communication to our team at Melissa Caven Design must be via email unless other contact numbers have been provided at our discretion. You may also contact us via direct message on Instagram, our team monitor this inbox daily. Our office hours are Monday, Tuesday, Thursday and Friday between 9:30am and 4:30pm
Agreement
By accepting our quote in writing, paying a deposit and signing below, you (the Client) agree to the terms outlined above. These terms are designed to protect both parties and create a smooth, stress-free project.
